Mejia v. Doe Excavation Pit
The Plaintiff, a minor, was severely injured when he fell into an excavation pit, owned by the Defendant, which was not properly guarded and enclosed. Discovery established that the Defendant had prior knowledge of the conditions of the fencing and that others had entered into the excavation area prior to Plaintiff's fall.
