Elias v. El Pollo Loco

Los Angeles County Superior Court (Class Action). Class action on behalf of current and former General Managers and Restaurant Managers of fast food chain El Pollo Loco for failure to pay overtime and provide meal breaks by classifying them as “exempt” under California law, even though they spent the majority of their work time performing non-managerial work.  A proposed settlement of this class action received preliminary approval by the court in December of 2009.

Sanchez v. Jack in the Box

Los Angeles County Superior Court (Class Action). Class action on behalf of current and former General Managers of fast food chain Jack in the Box for failure to pay overtime and provide meal breaks by classifying them as “exempt” under California law, even though they spent the majority of their work time performing non-managerial work.  The court recently ordered that the claims raised in the complaint must be resolved in arbitration and may not be brought on on a class-wide basis.  Plaintiff has appealed this ruling to the Court of Appeal.
