Elias v. El Pollo Loco

Los Angeles County Superior Court (Class Action). Class action on behalf of current and former General Managers and Restaurant Managers of fast food chain El Pollo Loco for failure to pay overtime and provide meal breaks by classifying them as “exempt” under California law, even though they spent the majority of their work time performing non-managerial work.  A proposed settlement of this class action received preliminary approval by the court in December of 2009.

Adams v. Michaels Stores

United States District Court – Central District of California.  Over 120 current and former Store Managers of retail chain Michaels Stores allege in this multi-plaintiff action that Michaels failed to pay overtime and provide meal breaks by classifying them as “exempt” under California law, even though they spend the majority of their work time performing non-managerial work, such as unloading freight, stocking shelves, and cashiering.

Mosse v. CVS Pharmacy

Los Angeles County Superior Court (Class Action). Class action on behalf of current and former Store Managers of drug store chain CVS for failure to pay overtime and provide meal breaks by classifying them as “exempt” under California law, even though they spend the majority of their work time performing non-managerial work, such as unloading freight, stocking shelves, and cashiering.

Sanchez v. Jack in the Box

Los Angeles County Superior Court (Class Action). Class action on behalf of current and former General Managers of fast food chain Jack in the Box for failure to pay overtime and provide meal breaks by classifying them as “exempt” under California law, even though they spent the majority of their work time performing non-managerial work.  The court recently ordered that the claims raised in the complaint must be resolved in arbitration and may not be brought on on a class-wide basis.  Plaintiff has appealed this ruling to the Court of Appeal.

McKoy v. Ameripride Guard Services

Los Angeles County Superior Court (Class Action). Class action on behalf of current and former security guard employees assigned to work 24-hour shifts while stationed in trailers at construction sites without overtime compensation or the ability to take proper meal and rest breaks.

Ojeda v. Dental Care on Premises

Los Angeles County Superior Court (Class Action). Class action on behalf of hourly paid dental assistants and other employees of a company providing mobile dental services at nursing and rehabilitation homes, alleging that they were asked to work off the clock and denied proper meal and rest breaks due to excessive workloads and pressures from management.

Bolanes v. Harbert Entertainment

Los Angeles County Superior Court (Class Action). Class action on behalf of current and former janitorial employees of hotels in the Ojai Valley for claims of overtime, minimum wage, and the failure to provide meal and rest breaks.

Paniagua v. Medical Management

United States District Court – Central District of California (Class Action). Class action brought by a former Pet Nurse of Banfield Pet Hospital on behalf of current and former hourly employees of the hospital (owned by Medical Management International), alleging that they were not compensated for time worked off the clock and for meal and rest breaks that were not timely provided, shorter than required by California law, or missed altogether.

Ghazaryan v. Diva Limousine

Los Angeles County Superior Court (Class Action). Class action on behalf of hundreds of limousine drivers alleging that Diva Limousine failed to pay them straight-time wages and overtime for time spent between “runs” while waiting for new assignments.  The Court of Appeal reversed trial court's denial of class certification and instructed the trial court to certify the case as a class action on behalf of current and former limousine drivers.

Gomez v. Lincare

Orange County Superior Court (Class Action). Class action on behalf of medical technician employees of Lincare, a nationwide provider of in-home medical equipment, alleging that they are not compensated for “on-call” shifts during which they field emergency calls from patients despite severe restrictions on their movement and discretion in how they use their time.

Juarez v. K-Mart

Contra Costa County Superior Court (Class Action). Class action on behalf of employees of various entities that provide janitorial services to retail giant K-Mart, alleging that they were not paid proper wages, including minimum wage and overtime compensation, or provided statutorily mandated meal and rest breaks.
